<br />e <br /> <br />e <br /> <br />e <br /> <br />127 <br /> <br />Consent Agenda Item 2n <br />Case No. 5-00CW296; Michael and Linda Rippy <br /> <br />Aoolication Summary <br /> <br />This is an application for an augmentation plan and change of diversion point near the Town of <br />Eagle (see attached map). The Applicants seek a number of new water rights inclUding two wells, <br />two pump and pipelines and a pond. The Applicants also seek to change its water rights in the <br />Kunkel-Allen Spring No.1 to divert that water from its wells. In addition, the Applicants seek to <br />augment depletions associated with the new and original diversions with water released from the <br />new pond al1d from Green Mountain Reservoir. <br /> <br />CWCB Ap,prooriations <br /> <br />The Board holds an instream flow water right for Brosh Creek and for the Eagle River in the <br />amount of 12 cfs for Brush creek and 130 cfs (5/1-9/30) and 50 cfs (10/1-4/30) for the Eagle River, <br />with appropriation dates of 7/27/77 and 3/17/80, respectively, which may be injured by this <br />application. <br /> <br />Potential for Iniurv <br /> <br />This application may not replace the depletions in time place and amount and thus may cause uyury <br />to the Board's Brush Creek and Eagle River instream flows, In addition, the Applicants cannot be <br />permitted an expansion of their water rights pursuant to the requested change. <br /> <br />Other Obiectors <br /> <br />The other objectors in this case are: B & B Excavating, Inc; Glen R.
