This is an application for a Plan for Augmentation and Change of water rights on the
South Fork of the Rio Grande near the town of South Fork in Rio Grande County (see attached
map). In this application, the Applicant proposes to augment depletions associated with several
wells supplying water to the Foothills Estates No.2 subdivision for domestic, commercial and
municipal purposes. The Applicant proposes to augment depletions with consumptive use
credits from the Church Ditch, which is located upstream. The wastewater is proposed to be
treated at a treatment facility located downstream from the confluence of the Rio Grande and the
South Fork of the Rio Grande.

CWCB Appropriations

The Board holds an instream flow right on the South Fork of the Rio Grande for 50.0 cfs during
the summer months and 25.0 cfs during the winter months with an appropriation date of August
16, 1982, which may be injured by this application. During the non-irrigation season, the Church
Ditch will not replace depletions to the Board's instream flow rights.
