Barry Family Partnership <br /> <br />A.wlication Summm:y <br /> <br />This is an application for surface water rights, storage water rights, and a plan for augmentation and <br />exchange. The Applicant is proposing to divert new junior water rights on Spring Creek, a tributary <br />to the Eagle River for recreational and piscatorial purposes and to augment the depletions with <br />releases from Ruedi Reservoir, Eagle Park Reservoir, or Wolford Mountain Reservoir (see attached <br />map). <br /> <br />CWCB Appropriations <br /> <br />The Board holds instream flow water rights on the Eagle River for various amounts with an <br />appropriation date of 3/17/1980. <br /> <br />Potential for Iniury <br /> <br />This application may cause injury to the Board's Eagle River instream flow water rights. At times <br />when the CWCB's Eagle River instream flow water rights are not being satisfied, the Applicant <br />must curtail diversions or augment depletions with releases from the Eagle Park Reservoir. <br />Releases from either Wolford Mountain Reservoir or Ruedi Reservoir win not augment the <br />depletions in the proper location so as to prevent injury to the CWCB' s instream flow water rights <br />on the Eagle River. <br /> <br />Other Objectors <br /> <br />. <br />The other objectors in this case are: the Colorado River Water Conservation District; the City of <br />Aurora; and Public Service Co. of Colorado. <br /> <br />L:\Section Folders\SECC\Case Files\200 I \501 CW366 _mem.doc <br />
