<br />. <br /> <br />. <br /> <br />. <br /> <br />Consent Agenda Item 1 c <br />Case No. 2-98CW82, Children of the Son <br /> <br />AJl,plication Summary <br />This is an application for a change of water rights and for a plan for augmentation in Fremont <br />County, near Canon City (See attached map). The Applicant seeks to augment its water rights that <br />will be used for a camp for underprivileged children, on a seasonal basis. <br /> <br />CWCB A,ppropriations <br />The Board has appropriated the following instream flow water rights that could be affected by this <br />application: <br /> <br />Case No. <br />98CWl49 <br /> <br />Stream <br />Texas Creek <br /> <br />Amount <br />7.75/3.5 cfs <br /> <br />Av,propriation Date <br />1/29/1998 <br /> <br />Potential for Injury <br />This application may not replace its out-of-priority depletions in time, place, and amount and, thus <br />may cause injury to the Board's Texas Creek instream flow water right. In addition, the <br />Applicant's change of water right, to divert at an upstream point of diversion, may injure the <br />Board's instream flow water rights. Moreover, the change of water rights may result in an <br />expansion of use. <br /> <br />Other Objectors <br />The other objectors in this case are: Carles and Margaret Davis; Lake Creek Water Users <br />Association; Ronald and Barney McClain; Paul Seegers and Trails and Ranch, LLC; Bovaird Land <br />Co. et al.; and the State Engineer and the Division Engineer for Water Division No.2. <br /> <br />L:\Section Folders\SECC\Case Files\2001\298CW82_mem.doc <br />
