<br /> <br /> <br />. <br /> <br />SUBJECT: <br /> <br />DRAFT POLICIES INVOLVING PROPOSED APPLICATIONS <br />FOR RECREATIONAL IN-CHANNEL DIVERSIONS <br /> <br />EFFECTIVE DATE: ? <br /> <br />PURPOSE: The Colorado Water Conservation Board (CWCB), pursuant to <br />sections 37-92-102(5), 37-92-102(6) & 37-92-305(13), C.R.S. <br />(2001), is required to file with a water court findings of fact and <br />recommendations regarding an application for a Recreational In- <br />Channel Diversion. The purpose of these policies is to provide a <br />process whereby entities seeking to apply for RICDs may obtain <br />informal comments from the Staff, the Board, and the public, <br />should they choose to pursue this informal process, This policy is <br />adopted to encourage collaboration between applicants for RICDs <br />and the CWCB Staff in order to develop superior RICD <br />applications and to provide ample time for exploration of issues of <br />potential concern, <br /> <br />APPLICABILITY: The policy and procedure shall apply to all applications for <br />recreational in-channel diversions prior to being filed with a water <br />court. <br /> <br />. <br /> <br />POLICIES: <br /> <br />1. Any entity that is considering filing an application for a <br />Recreational In-Channel Diversion CRICD") may elect to submit a <br />copy of the proposed application to the Staff of the CWCB for its <br />review and input, Staff will review and evaluate proposed <br />applications in a timely mallller. In addition, the Staff shall offer to <br />meet with an applicant to discuss the proposed application and any <br />concerns the Staff has about it. <br /> <br />2. If an entity that is considering filing a proposed RICD is <br />interested in obtaining Board and/or public input on the proposed <br />RICD, the Staff should accommodate such requests by developing <br />a preliminary staff recommendation, and by notifying the public by <br />including the item on a Board agenda, ' <br /> <br />3. The Board shall allow an entity considering filing a <br />proposed RICD to present its proposed application to the Board at <br />any regularly scheduled Board meeting, or any special Board <br />meeting. <br /> <br />. <br /> <br />4. In addition, the Staff and an entity interested in filing for a <br />proposed RICD application are encouraged to meet with the <br />individual Board member who represents the basin in which the <br />RICD would be located. <br /> <br />
