The Applicant, the Upper Y ampa Water Conservancy District <br />proposes to reuse up to 1000 acre feet of storage rights per year diverted from the Yampa <br />River basin to the Colorado River basin, The Applicant seeks reuse and successive use to <br />extinction allY return flows from irrigation water stored in Yamcolo Reservoir identified <br />in the proposed decree. The Applicant's proposed reuse of this water may iJ:ljure the <br />CWCB's instream flow water rights on Egeria Creek, as described below: <br /> <br />Case No. <br />5-95W290 <br /> <br />Stream <br />Egeria <br /> <br />Amount (cfs) <br />4 <br /> <br />Appropriation Date <br />12/5/79 <br /> <br />In order to assure full protection for the Board's instream flow water right, the Applicant <br />must agree to an accounting system such that, at any time the CWCB's instream flow <br />water right is not satisfied, the" Applicant wil11imit its diversions to the amount of the <br />available imported water. Such an accounting system must quantify the amount, location <br />and timing of available irrigation return flows. While discussions with the Applicant are <br />ongoing, we have not yet reached an agreement on terms and conditions that will fully <br />protect the CWCB's instream flow water rights. <br /> <br />Staff Recommendation <br />The Staff tecommends that the Board authorize the Staff to proceed to trial to protect the <br />CWCB's instream flow water rights on Egena Creek. <br /> <br />Flood Protection.
