<br />Location and Descrintion: The Animas.La Plata Project, located in
<br />southwestern Colorado and northwestern New Mexico is authorized to supply
<br />municipal. industrial, and irrigation water to the colorado Ute Indians and to
<br />non-Indians in the area. The project is to be developed in two phases. Phase
<br />1 will provide irrigation service for 42,815 acres, municipal and industrial
<br />water service. and some recreation and fish and wildlife features with a total
<br />estimated cost of qS26 million. Phase 2 is to be financed and constructed by
<br />non-Federal entities at an estimated cost of $lGO million.

<br />In June 1986, a cost-sharing agreement was signed with St~ta, Faderal, and
<br />Tribal entities, providing that Phase 1 of the project would bs constructed in
<br />not less than 12 years from initial construction, The Colorado Ute Indian
<br />Water Rights Settlement hct of 1988 was enacted to implement portions of the
<br />cost-eharing agreement and the December 1986 Final Settlement Agreement. If
<br />project water cannot be delivered to the Tribes by January 2000, the Tribes
<br />may elect (by January 2005) to commence litigation or renegotiation of their
<br />water rights claims on the Animas and La Plata Rivers,
<br />
<br />In October 1991, the Fish and Wildlife Service issued a final biological
<br />opinion that allowed construction to be initiated on three of the Phase 1
<br />features and the initial depletion of 57,100 acre-feet annually, Further
<br />development on the project was made dependent upon the outcome of 7 years of
<br />research to determine endangered fish habitat needs,
