<br />MEMORANDUM <br /> <br />TO: <br /> <br />Colorado Water Conservation Board Members <br /> <br />FROM: <br /> <br />Chris Bridges <br /> <br />DATE: <br /> <br />January 28, 1998 <br /> <br />SUBJECT: <br /> <br />Agenda Item No.5, January 28-29, 1998 Board Meeting - <br />Plans Accepted by the Office of Water Conservation program <br /> <br />BACKGROUND <br /> <br />The Water Conservation Act of 1991 (~~ 37-60-124 through 129, C.R.S. (1997)) (the "Act") states that <br />the Board shall not accept an application from a covered entity (entities that supply 2,000 acre-feet of <br />retail water annually for domestic, commercial, and industrial use) for financial assistance in the <br />construction of any water diversion, storage, conveyance, water treatment, or wastewater treatment <br />facility unless such covered entity includes a copy of their water use efficiency plan. The Board shall <br />consider a covered entity's water use efficiency plan in detennining whether to render financial <br />assistance. <br /> <br />OFFICE OF WATER CONSERVATION PLANNING PROGRAM <br /> <br />The Office of Water Conservation has developed an internal process to accept plans from covered entities <br />and to notify new entities that fall under the Act. This internal process includes criteria for acceptance <br />upon review of a water conservation plan (See attachment). We notify and work with any entity that does <br />not fulfill the Act's requirements of planning. This assistance is offered verbally, through written <br />correspondence or through on-site visits with the entity. <br /> <br />CWCB's loan application form will request information regarding the covered entity's water conservation <br />plan. The Board memos requesting approval of loan applications will inform the Board of the applicant's <br />water use efficiency plan. <br /> <br />CONCLUSION <br /> <br />The staff feels that the current process is sufficient for the Board to exercise its duties under the Act to <br />consider covered entity loan applicants' water use efficiency plans when deciding whether to render <br />financial assistance to those applicants. <br />
