RULING OF REFEREE

The above entitled application was filed on .Ju.ne 8,

1976, and was referred to the undersigned as Watel- Referee

for Water Division No.5, State of Colorado, by the Water

Judge of said Court on the 25th day of June, 1976, in

accordance with Article 92 of Chapt.er 37, Colorado Revised

Statutes 1973, known as r1'he Water Idght Determination and

Administration Act of 1969.

And the undersigned Referee having made such investi-

gat ions as are necessary to determine whether or not the

statements in the application are true and having become

fully advised with respect to the subject matter of the

application does hereby make the following determination and

ruling as the Referee in this matter, to-wit:

1. The statements in the application ar~ true.

2. The name of the struc-ture involved is Upper
Frying Pan Lake.

3. The name and address of the claimant is The
Colorado ~'later Conservation Board, 823 State Centennial
Building, 1313 Sherman Street, Denv.;!r, Colorado.

4. The source of the water is the Frying Pan River.

5. The lake is located at 39011'40" north latitude
and 106031'00" wczt longitude. This is in an Ul{surveyed
township. .S(:-~ctiqnal projections indic.'lte that the lake is
located in Section 11, T. 10 S., R. 32 W. of the 6th P.M.

If a conflict exist.s between the description by latitude
and longitude and the sec!:ional description, the description
by latitude and longitude will take precedence.
