RULING OF REFEREE

The above entitled application wa:; filed on December 3D, 1980,

and was referred to the undersigned as \'la,ter Referee for Water

Division No.5, State of Colorado. by the Water Judge. of said Court
on the 2nd day of February, 1981. in at:ccrdance with Atticle 92 of
Chapter 37. Colorado Revised Statutes :..973 J known as The }'lat.eX'
Right Determination and Administration Act of 1969.
And the unde-rsigned Referee having made such investigations as

are necessary to determine whether or not the statements in the

application are true a~d having become fully advised Hith respect
to the subject matter of the. applicaticm does hereby make the fol~
lowing determination arid ruling as the Referee in this matter,
to~wit:

1. The statements in the application .are true.

2. The name of the structure, involved is Mexican Cut
Natural Pond No.6.

3. The name of the claimant and address is The Colorado
Water Conservation Board; 1313 Sherman Street, 8th floor; Denver,
Colorado.

4. The source of the water is runoff tributary to the
South Fork of the Crystal River.
5. The lake is located at 39"01147" Nortl1 Latitude and
107003'49" West Longitude.
6. The use of the water is to maintain the minimum lake
level as required to preserve the natural environment to a re8son~
able degree.
1. The date of initiation of apPl'opriation is f\1arch 17,

1980.

8. The surface elevation of the lake is 11,088 feet, and
the total capacity of the lake is O~16 acre foot.

9. The water was first applied to the above beneficial
use on ~iarch 17, 1980, by action of the C.olorado Water Conservation
Board under the provisions of C.R.S. 1973, 37-92-102 (3), 37-92-
103 (3), (4) and (10).
