<br />AN ACT
<br />
<br />CONCERNING THE ADDITION OF THE COMMISSIONER OF AGRICULTURE TO THE
<br />COLORADO WATER CONSERVATION BOARD AS A NONVOTING EX OFFICIO
<br />MEMBER.
<br />
<br />Be it enacted by the General Assembly a/the State a/Colorado:
<br />
<br />SECTION J. 37-60-104 (1), Colorado Revised Statutes, is amended to read:
<br />
<br />37-60-104. Personnel. (1) The board shall consist of f6ltrteel, FIFTEEN members. The executive
<br />director of the department of natural resources shall be a voting member ex officio, The attorney
<br />general, state engineer, director of the division of wildlife, COMMISSIONER OF AGRICULTURE OR
<br />DESIGNEE, and director of said board shall be nonvoting members ex officio. The nine remaining
<br />members shall be qualified electors of the state, well versed in water matters, and shall be appointed by
<br />the governor, with the consent of the senate, for tenns of three years; except that no appointment shall be
<br />made wmeIt THAT does not confonn to the requirements of subsections (3) and (4) of this section. The
<br />appointments shall be made in such a maimer that the tenns of three members shall expire on February
<br />12 of each year. In case a vacancy occurs in the appointed membership of the board by death or
<br />resignation, the governor shall appoint a successor to serve the unexpired tenn of any member of the
<br />board within thirty days after the creation of such vacancy.

<br />SECTION 2. Effective date. This act shall take effect at 12:01 a.m. on the day following the
<br />expiration of the ninety-day period after final adjournment of the general assembly that is allowed for
<br />submitting a referendum petition pursuant to article V, section I (3) of the state constitution; except that,
<br />if a referendum petition is filed against this act or an item, section, or part of this act within such period,
<br />then the act, item, section, or part, if approved by the people, shall take effect on the date of the official
<br />declaration of the vote thereon by proclamation of the governor.
