R04-1112.02 Thomas Morris <br /> <br />HJR04-1074 <br /> <br />HOUSE SPONSORSHIP <br />Hoppe, Harvey, Larson, Brophy, Lundberg, Paccione, Rippy, Salazar, Spradley, and White <br /> <br />SENATE SPONSORSHIP <br /> <br />Entz, and Isgar <br /> <br />Senate Committees <br /> <br />House Committees <br /> <br />101 <br />102 <br /> <br />HOUSE JOINT RESOLUTION 04-1074 <br />CONCERNING ISSUANCE OF EASEMENTS FOR W A TERRIGHTS PURSUANT <br />TO THE REQUIREMENTS OF THE FEDERAL DITCH BILL. <br /> <br />I <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br /> <br />WHEREAS, The federal "Land Policy Management Act" <br />("FLPMA"), enacted in 1976, imperiled existm\l agricultural water <br />facilities on United States Forest Service ("USFS ') land by requiring <br />fee-based, time-limited special use permits; and <br /> <br />WHEREAS, Many agricultural ditches predate National Forest <br />designations; and <br /> <br />WHEREAS, Congress recognized the need for a certain water <br />supply for owners of agricultural ditches and, therefore, amended <br />FLPMA on October 27, 1986, by passing legislation (the "Ditch Bill") <br />exempting agricultural irrigation ditches from FLPMA's special use <br />perrrutting requirements; and <br /> <br />WHEREAS, The Ditch Bill was intended to ayoid burdensome <br />terms, conditions, and fees through permanent recognition of the use of <br />agricultural ditches on USFS land; and <br /> <br />Shading denotes HOUSE amendment.
