The ORIGINAL DEED OF TRUST was recorded to secure repayment of the indebtedness evidenced by the LOAN CONTRACT and PROMISSORY NOTE between the Grantor and the Beneficiary. Grantor and Beneficiary have agreed to amend the ORIGINAL DEED OF TRUST to reflect a change to collateral. NOW THEREFORE, the CWCB and Grantor agree that: 1. This DEED OF TRUST, APPENDIX C, AMENDMENT NO. 1, CONTRACT No. CT2017- 1209 (C150159) shall supplement and operate in conjunction with the ORIGINAL DEED OF TRUST, dated February 1, 2004, and incorporated herein by reference. 2. The Grantor has agreed to pledge the Project components, including approximately five miles of pipe, pumps and wells, as security for the loan in addition to the original pledge of Assessment Revenues backed by an assessment covenant. 3. In the event of any conflict, inconsistency, variance, or contradiction between the provisions of this amendment and any of the provisions of the original deed of trust, the provisions of this amendment shall in all respects supersede, govern, and control. 4. Any provisions of the original deed of trust not expressly modified herein remain in full force and effect. Appendix C to Amendment No. 1 Page 1 of 2
