1. PARTIES
This Grant Agreement (hereinafter called "Grant") is entered into by and between Lower Arkansas Va11ey
Water Conservancy District (hereinafter called "Grantee"), and the STATE OF COLORADO acting by and
through the Department of Natural Resources, Colorado Water Conservation Board (hereinafter called the "State
or CWCB").
2. EFFECTIVE DATE AND NOTICE OF NONLIABILITY.
This Grant shall not be effective or enforceable until it is approved and signed by the Colorado State Controller
or designee_ (hereinafter called the "Effective Date"). The State shall not be liable to pay or reimburse Grantee
for any performance hereunder, including, but not limited to costs or expenses incurred, or be bound by any
provision hereof prior to the Effective Date.
3. RECITALS
A. Authority, Appropriation, And Approval
Authority for the agency entering into this Contract arises from Colorado Revised Statutes (CRS) 39-29-
109(2)(c), 37-75-102 and 37-75-104(2)(c) and Senate Bi1106-179 adopted by the 2006 General Assembly,
and a sufficient unencumbered balance thereof remains available for payment. Required approvals,
clearance and coordination have heen accomplished from and with appropriate agencies.
