[El <br />DISTRICT COURT, WATER DIVISION 4, COLORADO <br />Case No. W -3366 <br />MOTION TO AMEND DECREE <br />IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE COLORADO <br />WATER CONSERVATION BOARD ON BEHALF OF THE PEOPLE OF THE STATE OF <br />COLORADO, <br />IN SAN CRISTOBAL LAKE, A NATURAL LAKE, <br />IN THE WATERSHED OF THE GUNNISON RIVER, <br />IN HINSDALE COUNTY, COLORADO. <br />The Colorado Water Conservation Board ( "CWCB"), through the <br />Colorado Attorney General's Office, moves this Court to amend the <br />decree in the above - captioned matter such that it conforms to the <br />application as filed and published. As grounds for this motion, <br />the CWCB states as follows: <br />1. The application, attached as Exhibit A, correctly <br />sets forth the CWCB's request for a water right in Lake San <br />Cristobal to insure the preservation of a minimum lake level to <br />protect the natural environment to a reasonable degree. The <br />application states that the lake in its natural condition con- <br />tains approximately 13,545 acre -feet, with a natural water sur- <br />face elevation of approximately 8995 feet. <br />2. The decree, however, granted a water right for <br />minimum flows rather than for a minimum lake level See Decree, <br />attached as Exhibit B, at paragraph (1) and at decretal paragraph <br />entitled "Use of Water." <br />3. The only objector, the United States of America, <br />reached a stipulation with the CWCB. See Order attached as <br />Exhibit C. Amendment of the decree as requested by this motion, <br />would in no way affect or impair the terms of the stipulation <br />with the U.S. <br />WHEREFORE, the CWCB requests that the Court enter an order <br />
