MEMORANDUM <br />To: Linda Bassi <br />First Assistant Attorney General <br />From: Rod Kuharich <br />Director, Colorado Water Conservation Board <br />Date: July 7, 2003 <br />Re: Request for Services <br />Case No. 4- 03CW107; Upper Gunnison River Water Conservancy District <br />(Gunnison River Watershed) <br />Please have your staff prepare a Statement of Opposition on behalf of the Board in 4- <br />03CW107. A review of the facts in the application indicates that the Colorado Water <br />Conservation Board ( "CWCB ") holds decrees for instream flow water rights on <br />Washington Gulch, the Slate River, and on the East River that may be injured by this <br />application. The CWCB requests that the Office of the Attorney General file a Statement <br />of Opposition to protect the CWCB's water rights from injury. The major areas of <br />concern in this case, which we feel should be included in the Statement of Opposition, <br />are as follows: <br />1. Applicant's proposed augmentation plan may not replace depletions in the time, <br />place, and amount to protect against injury to the Board's instream flow water <br />rights on Washington Gulch, the Slate River, and the East River. <br />2. The application does not present sufficient information to fully evaluate the <br />extent to which the Board's instream flow rights may be injured. <br />The attached Statement of Opposition Fact Sheet more fully describes the facts in this <br />case and lists the instream flow segment affected by this application. This Statement of <br />Opposition must be filed with the Division 4 Water Court by June 30, 2003. <br />Attachments <br />
