Colorado Department of Natural Resources, <br />hereinafter referred to as the "DNR" or the "STATE," and the Colorado River Water <br />Conservation District, acting by and through its Colorado River Water Projects <br />Enterprise; P.O. Box 1.120, Glenwood Springs, Colorado 81602; hereinafter referred to <br />as the "RIVER DISTRICT" or the "CONTRACTOR." <br />FACTUAL RECITALS <br />A. WHEREAS, authority exists in the law, and funds have been budgeted, appropriated <br />and otherwise made available and a sufficient unencumbered balance thereof <br />remains available for payment as follows: Fund No. 12H, Organization UCRP, GBL <br />SJ2, UC3, and UC4, Program ENVR, Object Code 2311, APPR. SJ2, UC3, and <br />UC4, Contract Encumbrance No. C10037. The total contract amount is $4,294,000. <br />B. WHEREAS, DNR has obtained and accomplished the required approvals, clearance <br />and coordination from and- with appropriate state agencies. <br />C. WHEREAS, section ~24-33-111, C.R.S. authorizes the STATE to make <br />nonreimbursable expenditures from the Species Conservation Trust Fund with <br />specific authorization from the General Assembly for the purposes of funding State <br />participation in Recovery Programs designed to meet obligations arising under the <br />federal Endangered Species Act of 1973. <br />D. _ WHEREAS, four-na#ive species of -fish that inhabit the Colorado River Basin, - <br />including portions of the Yampa River Basin within the State of Colorado, have- been <br />federally listed as endangered: the Colorado pikeminnow, humpback chub, bonytaif, <br />-and razorback sucker. <br />E. WHEREAS, on January 21, 1988, the "Recovery Implementation Program for <br />Endangered Fish Species in the Upper Colorado River Sasin" {"Recovery - <br />- Program"} was initiated by Cooperative Agreement between the Secretary of <br />Interior, the Governors of Colorado, Utah, -and Wyoming; and the Administrator of <br />-the V`Jes#ern Area Power Administration {incorporated herein by reference) to meet <br />obligations arising under the federal Endangered Species Act of 1973. <br />
