" <br />`A ~tESOLtJTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, <br />`APPROVI~tG THE LNTERGOVERNI~NTAL AGR~FMENT BETWEEN THE CITY OF <br />ASPEN A:'rTD THE COLORADO WATER CONSERVATION BOARD, REGARDII`'G - <br />- ~L~'STRE~i.~VI FLO'~S OAT CASTLE CREED. <br />WH£itEAS, the City's staff has negotiated an intergo~-•erntnental agxeeraent with staff <br />of the ,Colorado ~r'ater Conservation Board (C't~ICB) to allow effective adaiiaistration of the - - <br />- CWCB's decreed insrream flow on Castle Creek and better protection of the instream flow; and <br />V~HEREAS, the proposed inter?overrirnental agreement also provides that the City will <br />bypass a portion of its decreed water rights on Castle Creek if necessary to assure that the <br />'CW~~B's instream flow decree is fulfilled on Castle Creek between the Midland Fiume and the <br />confluence- of Castle Creek and the Roaring Fork River; and - <br />WHEREAS, the proposed intergovernmental agreement provides for the City to be <br />app~~inted a~ the GCB's agent for administration of the CVVCB's decreed instream flow; and " <br />- WH~.RE~S, the City has had, a longstanding policy supporting inscream flaw protection <br />~.on the ri;~ers and streams in -the Aspen vicuuty; and - <br />~~ V~~ERE:~S, the proposed i~atergovernmenta2 agreement wi11 further the City's instrean~ <br />flow protection policy; and - - _ - - <br />WHEREAS, the City's water department and water counsel have recommended approval <br />" of the proposed intergovernmental agreement; - <br />. ?VTO~V, T~IEREFORE, BE IT RESOLVED BY THE CI'T'Y COUNCIL OF THE CITY" " <br />'~ OP ASPEN; COLORADO, <br />That the City Council of the Gity of Aspen hereby determines that the proposed <br />intergovernmental agreement with the CwCB implements the City of Aspen policy of protecting <br />in3tream flows on the ,rivers and streams an the Aspen vicinity , and therefore authorizes the <br />
