Consent Agenda Item l.g
Case No. 3-07CW060: Application of City of Creede, Colorado
Application Summary
This is an application for approval of a plan for augmentation for the City of Creede. The
Applicant seeks to increase the pumping rate for Creede Well Nos. 1 and 2 from a cumulative rate
of 1.1 cfs to 1.1 cfs for each well, up to a cumulative rate of 2.2 cfs. The source of groundwater is
the allu~~ium of Willow Creek, a tributary of the Rio Grande, and the alluvium of the Rio Grande.
These wells do not ha~~e indi`~idual water rights; they may only operate in accordance with the plan
for augmentation decreed in Case No. 94CW31 and the plan sought in this application. The
Applicant's sources of augmentation are 0.5 cfs of the Kanawha Ditch and Pipeline (aka Nelson
Tunnel) water right and 0.5 cfs of the Cochran-Pioneer Ditch water right. The former is considered
an independent supply, not tributary to any stream, developed by the Nelson Tunnel and
surrounding mine workings; the latter diverts from Willow Creek and was previously transferred
from the Rio Grande to its current point of di`~ersion on Willow Creek. Both sources of
augmentation water are located upstream of the wells on Willow Creek.
CWCB Appropriation
The CWCB holds the following instream flow water right that could be injured by this
application:
CWCB Stream/Lake Amount Approp. Watershed County
Case No. cfs Date
3-83CW049 Rio Grande River 150/65 8/16/82 Rio Grande headwaters Mineral
Potential for Injury
Applicant's proposed plan for augmentation may injure the Board's instream flow water rights on
the Rio Grande Ri~~er by not replacing depletions in time, amount and location.
Other Objectors
The Rio Grande Water Users Association also filed a Statement of Opposition to this application.
