The loan is for rehabilitation of the Tilton Lateral.

The Soard approved a Small Project Loan from the Construction Fund in a maximum amount of
$100,000. The loan terms are 3.5% for 30 years. I have attached a copy of the updated Soard
memo concerning Tilton Lateral Inc. Please refer to page 4 of that memo and to the section "Action
taken by the CWCS May 21, 2001."

. When the Soard approves a Small Project Loan there remain several conditions:

a) A Feasibility Study is reauired. John Van Sciver has reviewed the study titled "Feasibility Study
of new Underground Piped System for the Tilton Lateral Irrigation Water Users" by the Tilton
Lateral Company. The report meets the requirements of the CWCS Construction Fund
Guidelines for feasibility studies.

b) An approved contract must be in place before funds can be advanced. Jan IlIian has placed
this project on our contracting "hot list" and has initiated the loan contracting process. I
understand the project will be constructed in fall 2001, and that the Company will need funds to
pay contractor bills on or about October 1, 2001. Our goal is to have the loan contract signed
by all parties to meet these scheduled dates.

c) You must adhere to the CWCS Desian and Construction Administration Procedures. Tim
Feehan will contacted you regarding the CWCS requirements concerning project bidding,
design, and construction. Tim will make construction inspections, which will be the basis of the
monthly pay estimates for disbursement of your loan funds.

d) You must adhere to the CWCS Guidelines for Financial Assistance.

Flood Protection · Water Project Planning and Financing.
