The CWCB may acquire conditional water <br /> <br />rights, change their use to instream flow <br />protection in state water court, and <br /> <br />exercise the acquired priority to protect <br /> <br />instream flows, provided the contemplated <br /> <br />draft standard is met and no other water <br /> <br />rights are injured. <br /> <br />2. A private party that was interested in <br />protecting instream flows could also <br /> <br />acquire conditional water rights and then <br /> <br />convey them to the CWCB for change to <br /> <br />(. <br />~ <br /> <br />instream flow protection. <br /> <br />a. The CWCB has already entered such <br /> <br />contracts with the City of Aspen and <br /> <br />The Nature Conservancy who turned over <br /> <br />absolute irrigation and municipal water <br /> <br />rights for change to instream flow <br /> <br />protection. <br /> <br />1) The City of Aspen simply licensed <br /> <br />some of its Hunter Creek water <br /> <br />rights to the CWCB and joined the <br /> <br />CWCB as a co-applicant in the <br />change of water rights proceeding. <br /> <br />2) The Nature Conservancy purchased <br /> <br />the Berkeley Ditch water right on <br /> <br />23 <br />
