Patterson, <br />Chief Engineer, <br />Water Conservation Board, <br />State Office Building, <br />Denver, Colorado <br /> <br />Dear Mr. Patterson: <br /> <br />Since our telephone conversation of this morning <br />concerning your letter of ~larch lOth requesting certain <br />information as to Amity Canal diversions, etc., I have <br />considered the best way in which to make the informa- <br />tion available to you or to your representative . <br /> <br />As to the period beginning April 1st or April <br />15th, 1936 (organization of Amity Mutual Irrigation <br />Company) I believe the annual reports to the stock- <br />holders of thCl.t company, particularly the superintend- <br />entls report, should furnish most of the information <br />you request, except perhaps as to the regulation waste, <br />and for this doubtless the superintendent's books at <br />Holly would have the facts. As to the period cover- <br />ing the operation of the Amity system from 1897 or <br />1998 until 1928, I believe certain exhibits in the case <br />of AVSB&ILCo v. Markham, et al. (U. S. District Court <br />No. 8292), with which you are familiar, would give <br />about all the information requested. These exhibits <br />are numbers 79, 80, 85, 86, 87, 88, 91, 114, 115, 120, <br />121, 141, 142 and 146. Judge Symes today, upon my <br />request, gave instructions to the Clerk of the Court, <br />Mr. Bowman, to permit me to withdraw these exhibits <br />and when your representative so requests I can bring <br />them over to my office where he can go over them at <br />his leisure. For the period between 192$ and April <br />1936, the original records of the AVSBe,ILCo. in the <br />possession of either Mr. W. D. Shackelford, at Holly, <br />or perhaps now turned over to the Amity Mutual Company, <br />at Holly, would serve the Durpose. <br /> <br />I know you do not need our assurance of our <br />willingness to cooperate with your Board and you in <br />the matter of investigation. <br /> <br />HC'l!f <br /> <br />Yours very truly, <br /> <br />~/tU <br />
