The specific criteria for <br />such participation are listed in Section 5. <br /> <br />.... <br />'""' <br /> <br />Although not formal, voting, participants in the Implementation <br />Program, any member of the public may attend the open meetings of <br />the Committees and present his or her concerns or recommendations <br />for the consideration of Program participants. <br /> <br />In order to carry out the Implementation Program, three <br />committees will be established: a Biology Committee, an Operating <br />Committee, and a Coordination Committee. The composition and <br />functions of each committee are discussed in Section 5.0. <br /> <br />Participation in the Implementation Program is voluntary. Each <br />participant will assess whether the Implementation Program goals <br />are being achieved. If any party decides not to continue its <br />participation, that party will submit its reason(s) to the <br />Coordination Committee in writing. The Coordination Committee <br />will be given sufficient time to resolve any problem(s). If a <br />party's participation in the Implementation Program is essential <br />to implementing a reasonable and prudent alternative to avoid <br />jeopardy to the endangered fish, its withdrawal may result in <br />reinitiation of consultation under section 7 of the Endangered <br />Species Act. <br /> <br />1.6 TRUST RESPONSIBILITIES <br /> <br />The reservations of four federally recognized Indian tribes are <br />located within the Basin. The four tribes have reserved water <br />rights under federal law, most of which have not been quantified, <br />to provide water to the reservations for use as permanent <br />homelands. The Secretary of the Interior has a trust <br />responsibility to assert and protect the trust water resources of <br />the tribes. <br /> <br />with regard to three of the four tribes, there currently are <br />specific federal plans for the partial development of tribal <br />water resources. Under the Act of June 13, 1962, 76 Stat. 96, <br />congress authorized, among other things, the construction of the <br />Navajo Indian Irrigation Project (NIIP) to benefit the Navajo <br />Nation. Based on congressional actions, six of the NIIP's 11 <br />blocks have been fully constructed and Blocks 7 and 8 are <br />currently under construction. Congress has consistently provided <br />annual appropriations for NIIP's completion. <br /> <br />On June 30, 1986, the Under Secretary of the Interior signed an <br />agreement which established the principles for settlement of the <br />reserved water right claims of the Southern Utes and Ute Mountain <br />Utes and the financial arrangements for the settlement and for <br />the construction of the Animas-La Plata Project. The nonfederal <br />cost sharing commitments contained in the agreement were in <br />
