(Energy Contract~ The Upper Division contends that since (1) the Hoover Power contracts are subject to the Colorado River Compact, 1lI (2) one of the stated purposes of the Compact is to provide storage in the Uoper Colorado River Basin, and (3) the Compact makes the use of water at Hoover Dam to generate power junior in priority to the use of such water for domestic and agricultural uses; therefore, the United States is excused from delivering electric energy under said contracts to the extent the water is withheld to fill the Colorado River Storage Project reservoirs under Section 602 (a) of P.L. 90-537, and is not required to compensate the Hoover power contractors for deficiency in l~ Section 2 (d) of the Boulder Canyon Project Adjustment Act (54 Stat. 774; 43 U.S.C. 618a) created the Colorado River Development Fund by the transfer of $500,000 annually, commencing in 1938 and continuing until 1987. The Act provides that during 1956-1987 the fund shall be used under the direction of the Secretary.
