<br />. <br /> <br />. <br /> <br />of the Colorado River Development Fund as provided in the Boulder <br /> <br />Canyon Project Adjustment Act .1W Such a decision by the Secretary <br /> <br />would accomplish the unjust result of carrying out one part of <br /> <br />the Seven-State Agreement, but disregarding the reciprocal promise <br /> <br />by the Upper Division to support legislation to continue the <br /> <br />Filling Criteria and the Hoover power deficiency allowances. <br /> <br />III. <br /> <br />THE DIRECTIVE IN SECTION 602 (a) OF P.L 90-537 <br />TO THE SECRETARY TO WITHHOLD WATER IN LAKE POWELL <br />FOR THE PURPOSES STATED THEREIN DOES NOT EXCUSE <br />THE UNITED STATES FROM PERFORMING ITS OBLIGATIONS <br />TO METROPOLITAN UNDER THE UNITED STATES-METROPOLITAN .20/ <br />ELECTRIC ENERGY CONTRACT DATED MAY 29, 1941. (Energy Contract~ <br /> <br />The Upper Division contends that since (1) the Hoover Power <br /> <br />contracts are subject to the Colorado River Compact, 1lI (2) one of <br /> <br />the stated purposes of the Compact is to provide storage in the Uoper <br /> <br />Colorado River Basin, and (3) the Compact makes the use of water at <br /> <br />Hoover Dam to generate power junior in priority to the use of such <br /> <br />water for domestic and agricultural uses; therefore, the United <br /> <br />States is excused from delivering electric energy under said contracts <br /> <br />to the extent the water is withheld to fill the Colorado River Storage <br /> <br />Project reservoirs under Section 602 (a) of P.L. 90-537, and is not <br /> <br />required to compensate the Hoover power contractors for deficiency in <br /> <br />l~ <br /> <br />Section 2 (d) of the Boulder Canyon Project Adjustment <br />Act (54 Stat. 774; 43 U.S.C. 618a) created the Colorado <br />River Development Fund by the transfer of $500,000 annually, <br />commencing in 1938 and continuing until 1987.
