<br />. <br /> <br />. <br /> <br />"Section 8 deals with the financial problems created <br />by the filling of Lake Powell and the resulting impairment of <br />firm power production at Hoover Dam. Substantial payments <br />have already been made out of the upper Colorado River <br />Basin fund to compensate Hoover Dam power contractors for <br />deficiencies in power Generation at Hoover Dam, and <br />additional payments may have to be made in the future <br />under the Glen Canyon fillinG criteria. <br /> <br />Section 8 provides for the repayment of such expenditures <br />heretofore or hereafter made out of the upper Colorado River <br />Basin fund. This is to be accomplished by transferring <br />$500,000 each year to the upper basin fund from the Colorado <br />River development fund (CRDF) created by the Boulder Canyon <br />Project Adjustment Act of 1940, commencing with the <br />enactment of this act. The CRDP now receives $500,000 <br />per year from Hoover Dam power revenues earmarked for use <br />in the development of projects and will continue to do so <br />under existing law until 1987. The effect of section 8 is <br />to earmark that same amount ($500,000 annually) for transfer <br />to the upper Colorado River Basin fund instead. If any <br />deficit in reimbursement of the upper Colorado River Basin <br />fund exists after 1987 the remaining deficiency is to be <br />paid out of the new lower Colorado River Basin development <br />fund which is established by section 5 of this act." <br />(Emphasis added) <br /> <br />This Senate Committee Report indicated that the Committee <br /> <br />intended that the Filling Criteria would continue until terminated <br /> <br />at some later date. In commenting on Section 11 (a) of S. 1004 (same <br /> <br />text as Section 601 (a) of H.
