<br />Annual Report for 1990 <br /> <br />Attorney's Report <br /> <br />To <br /> <br />The Shareholders and Directors <br />The Amity Mutual Irrigation Company <br />Holly, Colorado 81047 <br /> <br />Ladies and Gentlemen: <br /> <br />In our report to you of last year, I discussed several cases <br />then pending; I note that most of them are still pending as of <br />the present time. I hope that some progress has been made <br />during the year, but none of them have been finally put to rest. <br /> <br />The report last year ended with discussion of the action <br />brought against the company by Mr. Elwood Gillis, Mr. Charles <br />Bennett and Mr. and Mrs. Donald Tyner (KOA Campground) <br />wherein they claim money damages allegedly caused to their <br />property from breaks which occurred in the canal on <br />September 2, 1986. We held two settlement conferences and <br />the plaintiffs took the depositions of Mr. Frank, Mr. Davis and <br />Mr. Hott during the year, but no settlement resulted and the <br />case is still pending, set for jury trial on April 29, 1991. <br /> <br />During the year some time was again spent by the officers <br />of the company In connection with the case brought in the <br />United States Supreme Court by the State of Kansas against <br />the State of Colorado. The deposition of Mr. Frank was taken <br />by the State of Kansas lawyers in two sessions, the last being <br />March 9, 1990; also they took the deposition of Mr. Ed <br />Blackburn, the President of the Ft. Lyon Canal Company. Trial <br />of the case commenced in September and, according to the <br />latest reports, the State of Kansas was supposed to conclude <br />its testimony by January 31; Colorado apparently is going to <br />put its case on during the months of February and March. <br />Several persons in District 67 have been endorsed on as <br /> <br />Page 4 <br />
