<br />l, <br /> <br />I <br />I <br />I <br /> <br />I <br />I) <br /> <br />) <br />~ <br /> <br />The Amity Mutual Irrigation Company <br /> <br />1389 <br /> <br />WHEREAS, pursuant to the terms of the decree in the <br />certain suit in Bent County, Colorado in which the Fort Lyon <br />Canal Company was plaint ill and the Amity Mutual Irrigation <br />Company was defendant, the terms thereof proved that the <br />rates of division of the expenses should remain at the amounts <br />fixed by said decree until November 1, 1990 and whereas, no <br />additional regular meeting of the Stockholders will occur <br />between now and said decree; <br />"NOW THEREFORE BE IT RESOLVED, that the <br />Stockholders do hereby authorize it's Board of Directors, <br />Ollicers and Attorney to take any and all action deemed <br />necessary or expedient, or refrain from action as may seem <br />most expedient to them for the interest of the Company and to <br />ratify and confirm the acts of the Directors, Ollicers and <br />Attorney in such matters as may be adjusted or determined". <br />A motion was made to accept by Carl Shinn and seconded <br />by Jim Rogers. Motion passed. <br />WHEREAS, Amity Mutual Irrigation Company, after long <br />discussion and dispute, finally permitted the entry of a decree <br />permitting the old Model Reservoir Decree to be moved to a <br />New Bureau of Reclamation Dam constructed on the Purga. <br />toire River, just above Trinidad, Colorado, in about 1967; and <br />WHEREAS, since the construction and completion of <br />Trinidad Dam, the Amity has felt that the operation of the river <br />at Trinidad has frequently resulted in reduction of flows that <br />belong in John Martin Reservoir and <br />WHEREAS, the Purgatoire Conservancy District and City <br />of Trinidad have each filed objections to these applications, <br />NOW THEREFORE BE IT HEREBY RESOLVED, that the <br />Amity continue to oppose these applications and do all within <br />its lawfui power to see that the Trinidad Reservoir is operated, <br />in the future, strictly in accord with the decree that Amity <br />ag reed to in 1967 and <br />RESOLVED that the Division Engineer, the State Engineer <br />and the Lawyers representing them be requested to withdraw <br />their approval of the applications and to join Amity in it's <br />opposition to the appl ications. <br /> <br />P-3 <br />
