BEWS <br />ASSISTANT ATTORNEY GENERAl. <br /> <br />November 20, 1996 <br /> <br />Doug Young <br />Office of the Governor <br />136 State Capitol <br />Denver, Colorado 80203-1792 <br /> <br />0: Options for the Animas-La Plata Project <br /> <br />Dear Mr. Young: <br /> <br />Thank you for the opportunity. to provide comments <br />concerning options for the Animas-La Plata Project (ALPI and to <br />participate in these discussions on behalf of the Navajo Nation. <br /> <br />The currently conceived configuration for the ALP <br />includes an annual wa~ar M&I water supply for the Navajo Nation in <br />the amount of 7,600 acre-feet. This. supply is included.in Phase I, <br />Stage A and was included in the Reasonable and Prudent Alternative <br />that passed muster under Section 7 of the Endangered Species Act <br />(ESAI. Neither the current configuration nor any of the proposed <br />alternatives for the ALP include delivery facilities for this water <br />to the Navajo Nation. <br /> <br />On behalf of the Navajo Nation, I respectfully propose <br />that the parties to these discussions consider the following option <br />as part of any alternative configuration: using the existing <br />storage at Navajo Dam to store 7,600 acre-feet annually of water <br />for use by the Navajo Nation. For such an option to be attractive <br />to the Navajo Nation, the Nation must have the ability to utilize <br />such water for a variety of purposes and without additional ESA- <br />imposed constraints.
