Rogers and Carl <br />G. Genova, were most recently appointed by Governor Romer on November 13, 1989. <br />Executive Order A 248-89 specifies that their terms expire August 16, 1993. It is <br />probably time to begin thinking about their reappointment or replacement. <br /> <br />The Arkansas River Compact requires that two of Colorado's three <br />representatives be water users and residents of the Arkansas Valley, one from above <br />John Martin Reservoir (Districts 14 and 17) and one from below John Martin <br />Reservoir (District 67). Compact, Article VIII.C. Carl Genova has represented <br />District 14 and 17 since 1981 and Jim Rogers has represented District 67 since 1985. <br />Chuck, of course, as CWCB director is the third representative. It is customary that <br />the CWCB director take the lead on recommending to the Governor, through the <br />Executive Director's Office, appointments to ARCA Recently, due to the Supreme <br />Court case with Kansas, the CWCB Director has also consulted with counsel (David <br />Robbins) on ARCA appointments to retain continuity during the litigation. <br /> <br />Since last December, I have talked briefly with Carl and Jim concerning their <br />interest in reappointment to ARCA for another four years. Jim definitely wants to <br />serve again. Carl expressed reluctance to serve due to other demands on his time and <br />a belief that representation of Districts 14 and 17 should move down river to someone <br />living closer to John Martin Reservoir. I asked him to think this over, particularly to <br />see us through Kansas v. Colorado and to suggest suitable replacements if he could <br />not serve again. <br />
