<br />i <br /> <br />PURPOSE OF THE FINAL SUPPLEMENT TO THE FINAL ENVIRONMENTAL <br />STATEMENT <br /> <br />A Final Supplement to the Final Enviromnental Statement (FSFES) for the Animas-La Plata <br />Project (INT FES 80-18) has been prepared to meet the procedural requirements of the <br />National Enviromnental Policy Act (NEP A). The Council on Environmental Quality <br />Regulations for Implementing the Procedural Provisions of the NEP A (40 CFR Parts 1500 to <br />1508) (CEQ Regulations) provides the legal and regulatory guidelines for preparation of <br />enviromnental impact statements. The FSFES is tiered to the 1980 FES to eliminate <br />duplication and repetitive discussions of the same issues and incorporates by reference <br />information from the 1980 FES (40 CFR 1508,28 and 1500.40)). <br /> <br />Although a Financial and Economic Analysis is not required as part of the FSFES, an analysis <br />has been prepared and is available. <br /> <br />The FSFES displays alternatives that respond to these factors and compares them to the 1980 <br />selected alternative (1980 FES Plan) and the No Action Alternative. The FSFES does not re- <br />examine the range of possible alternatives but incorporates the alternative development <br />process from the 1980 FES. Additionally, a wide range of alternatives was examined as part <br />of the 404(b)(I) Evaluation. <br /> <br />The Supplement to the 1980 FES for the Project was prepared because of the following <br />reasons: <br /> <br />The CEQ Regulations state that Federal agencies shall prepare supplements to final <br />enviromnental impact statements when: <br /> <br />. Substantial changes have been made in the proposed action that are relevant <br />to enviromnental concerns (40 CFR 1502.9(c)(I)(I)) <br /> <br />· Significant new circumstances or information relevant to enviromnental <br />concerns has a bearing on the proposed action or impacts (40 CFR 1502.9 <br />(c)(1 )(ii)) <br /> <br />Reclamation reviewed the information and enviromnental analyses of the Project contained in <br />the 1980 FES. The following changes, circumstances, and information meet the Council on <br />Enviromnental Quality requirements for preparation ofa supplement to the 1980 FES: <br /> <br />(1) Implementation of provisions of the Settlement Act constitutes significant new <br />circumstances relevant to enviromnental concerns that may have a bearing on the Project <br />impacts. <br /> <br />(2) A number of design refinements or changes to Project features and operation since <br />the 1980 FES are relevant to enviromnental concerns. <br /> <br />14 <br />
