Owens believes that the U.S.G.S. data supports their claim. <br />The largest ditch downstream from the Sterling. No.1 Ditch is <br />the Harmony Ditch, which has a very junior direct flow right. <br />(Interview, Ralph OWens, 1/30/67). <br />The Weldon Valley Ditch Company Board of Directors stated <br />that the Ogilvy Ditch, which lies upstream from them in Water <br />District No.2, has recently been "called" by the Sterling No. 1 <br />Ditch. They believe that this is the first time in history that <br />the "critical ditch" calls have reached upstream from the Weldon <br />Valley Ditch. They have even heard that the Sterling No. 1 Ditch <br />"call" has reached as far upstream as the Lower Latham Ditch, just <br />below the mouth of the Poudre. <br />The Weldon V81ley Board complained that the Sterling No. 1 <br />Ditch is allowed to waste water and take more than it actually <br />needs for irrigation. According to them it demands a full 114 <br />c/f/s delivery continually, regardless of need, throughout the <br />irrigation season. They have investigated and have seen the <br />Sterling No.1 Ditch spilling water in three such places at a <br />time when it had called its senior priority. They complained to <br />Mattern and Owens,and,Mattern "sent a man down who caught the <br />Sterling No. 1 wasting water but nothing was done about it." They <br />believe that the Sterling No. 1 is run in this fashion to provide <br />for junior downstream ditches. <br />The Weldon Board also charged that the Sterling No.1 Ditch <br />had moved its headgate upstream 5 miles to a leaky earth dam, <br />rather than using its good concrete dam at the decreed point of <br />diversion.
