SECRETARY: In accordance with the provisions of section <br />l(c) of the Flood Control Act of Decemher 22,1944 (58 Stat. 886_) <br />this office has reviewed yom', proposed report of September 19!in <br />the Ruedi Dam and ReservOlr as a part of the FrYlDgpan-Arkan~ <br />project in Colorado, Since the State of Colorado rendered materIal <br />assistance in the preparation of this report, we are already famIliar <br />wit.h ~he dctails contained therein. 'n,is report meets the full and <br />uneqUIvocal approval of the State of Colorado and we are extremely <br />grateful to the Bureau of Reclamation for the expeditious manner III <br />which this report was prepared, <br />Your proposed report indicates that the total reimbursable invest- <br />ment allocated to municipal .and industrial water supplies for use in <br />Colorado west of the Continental Divide can be reasonably expected <br />10 he repaid with interest under the provisions of the Water Supply <br />Act of 1958, Public Law 85-500. Your proposed report notes further <br />that in the ahsence at this time of agencies or organizations qualified <br />t<> contract for repayment of the cost assigned to such deferred mu- <br />nicipal and industrial water supply, it will be necessary that the State <br />of Colorado, prior to transmittal of this report to the Congress, fur- <br />nish assurallce as to future repayment as reQuifea bv the Water Supply-- <br />Actof1958_ '. <br />. It is the purI10se of this letter to furnish such assurance. ''Ve a. <br />ticipate, as does your report, that commercial development of Col <br />rado's oil shale reserves will create a future market for the municipal <br />and industrial water supply that would be provided by Ruedi Dam and <br />~eservoir. Should such a market, however, not dcvelop to a degree <br />suftkient to return the costs allocated to municipal and industrial wa- <br />ter supply, the State of Colorado will undertake !"2paY!J1ent of the <br />ortion necessa to assure fun re a ment of muniC"iDrLrand-mnustriiI- <br />water Stipp v costs. <br />The proposed report pointed out certain discrepancies between the <br />operating principles adopted for the Fryingpan-Arknnsas project by <br />the Staffi of Colorado with certain provisions of reclamation law and <br />polil'.Y. These apparent inconsistencies have been reviewed with the <br />staff of the Bureau of Rechllnation and we anticipate that U,cse op- <br />erating principles will be revised to meet the objection pointed out to <br />us.
