<br />/ <br /> <br />. <br /> <br />. <br /> <br />Memorandum <br />Animas-La Plata <br />December 9, 1992 <br /> <br />o Changed requirements for certification of Project lands for potential toxic or <br />hazardous irrigation return flows, <br /> <br />o Exemption of additional Project features from the requirement to obtain a <br />Clean Water Act section 404 permit for construction activities resulting in <br />discharges of dredged or fill material into the waters of the United States. <br />The Supplement includes a 404(b)( 1) evaluation of additional Project features <br />that were described in the recommended plan but not included in the original <br />404(b)(1) evaluation attached to the 1980 FES. <br /> <br />A formal scoping program has not been conducted for the Supplement. Since 1980, <br />Reclamation has received a great deal of input on the Project, including a public <br />referendum; nevertheless, information was solicited from interested individuals, <br />organizations, and agencies, as discussed in chapter V. <br /> <br />The Supplement does not address the 1980 FES plan in detail, since a full description <br />of the plan is contained in both the 1979 DPR and 1980 FES. Further, the Supplement <br />does not address or include any discussion about reformulation of the Project, including <br />reformulation or consideration of alternatives to the Project. Reclamation believes that <br />Project planning requirements were fully met in the 1979 DPR, the feasibility report, and <br />1980 FES, and, accordingly, that other alternatives to the Project were evaluated adequately <br />in the 1980 FES. However, Reclamation has included, as part of the 404(b)(1) analysis, <br />evaluation of alternatives for each of the features covered in the analysis. It does not <br />analyze alternative plans related to the Colorado Ute Tribes' potential water marketing. <br />Whether the Colorado Ute Indians ultimately market their allocated Project water is outside <br />the scope of Reclamation functions and responsibilities. <br /> <br />Also excluded from the scope of the Supplement is a detailed analysis of the <br />operation of Navajo Dam, located on the San Juan River in northwest New Mexico. <br />Reclamation has determined that analysis of current Navajo Dam operation and associated <br />research are not within the scope of this documentation because a separate, future NEP A <br />process and document will be prepared on Navajo's future long-term operating criteria. <br />That NEP A compliance will be completed at the conclusion of the ongoing endangered fish <br />research program on the San Juan River, estimated to be completed in 1997 when a <br />decision concerning long-term operation of Navajo will be made. <br /> <br />3 <br />
