The Colorado State Engineer also advised Kansas of his conclusions and <br /> <br />directives to the District by letter dated September 24, 1993. Subsequent to the Colorado State <br /> <br />Engineer's determination of no overstorage and directive to change the stock water releases, the <br /> <br />District committed to changing the stockwater releases and again requested Reclamation to <br /> <br />approve the amended operating principles. <br /> <br />Kansas responded to the Colorado State Engineers September 24, 1993 letter on <br /> <br />November 16, 1993. Kansas again concluded that in 1992 the storage in Trinidad Reservoir <br /> <br />exceeded the limits authorized by the operating principles. Kansas also agreed that the District <br /> <br />had not released the stockwater in accordance with the operating principles. Kansas reconfirmed <br /> <br />its request that Reclamation not approve the amended operating principles as operations in the <br /> <br />past and presently continue to deviate from the operating principles. The Colorado State <br />~ <br />Engineer responded to Kansas' letter of November 16, 1991 alleging continuing violations of the <br />operating principles on December 2, 1993 with an explanation of the accounting for stockwater <br /> <br />releases in his analysis of storage in Trinidad Reservoir from November I, 1988 through October <br /> <br />1993. <br /> <br />After considering the positions of Colorado and Kansas, the ARCA took no action <br /> <br />concerning the proposed amended operating principles at its annual meeting in December 1993. <br /> <br />Neither the AReA nor Reclamation took any further action to approve proposed amended <br /> <br />operating principles for the Project until the operating principles were amended to enlarge the <br /> <br />6 <br />
