The asking price is $125/AF/yr. The State is also offering sale of water

from the proposed Deer Creek Reservoir which is conditional at this time. The asking

price is $100/AF/yr.
Recently Wyoming negotiated for the pUIchase of water rights for the Middle Fork

Darn on the Powder River. The State purchased the conditional water rights from the

Powder River Reservoir Corporation (PRRC) at an approximate cost of $50/AF. This cost

was established on the basis of the expense of filing and design work by the PRRC and

Exxon. In addition, Exxon has purchased an option to buy 16,500 acre-feet of yield from

the Middle Fork Reservoir when it is built. The cost agreed upon is based on the

amortized cost of construction plus operation and maintenance costs. While the cost is

not fixed, it is estimated to be about $250/AF/year.

One other recent purchase involved the transfer from agricultural use to municipal

use in the North Platte River basin. The price for this water right was $2,000/AF of water

righ~ made available to the town, i.e. the amount consumed by the agricultural use.

Summarv of Market Transactions

The determination of a market value of a conditional water right based on

compa'rable transactions is difficult. The market considers many factors not all of which
,
\
are related to the value of water. Probably the most relevant comparable sale to the

12
