Paragraph 74, pnge.s 27 to 33, both inclusive. under the heading <br />"Operat.ing Principles," cont.ains the operating principles which the <br />report exphtins were recommended by fI. policy and review committee <br />set up by the Colorado Water Conservation BOlml to study and re- <br />view plaus aud report.s on the first stage of the Gunnison-Arkansas <br />project. This committee was COTIlposed of representatives of the <br />board, the Colorado Game llOcI Fish Commission, \\~cst.ern Colorado, <br />the Arkansas Valley, and the City of ColOl'ado Springs. The report <br />fRil~ to explnin that. such commit.tee was required to report to the <br />Colorado \\Tater Conservat,ion Board and i~s recommendations would <br />not he effective until approved by that board. The report on the <br />project does not, disclose what action was taken hy t.he Board nor <br />does it contain all of the recommendations of the Policy and Review <br />Committee. Same of t.he matters eontained in the report of the com- <br />mittee are not strictly concerned wit.h project operation. but are <br />related to, and constitute n. material part of, such operating principles. <br />The recommendations of the Policv and Review COInnlittee were <br />revised and approved by the Colorado Water Conservation Board on <br />February 22, 1951. (See letter with attacbments of the director of <br />the Colorado Water Conservation Board dated February 27, 1951, <br />and addressed to the director of region 7, Bureau of Reclamation.) <br />Paragraph 74, pages 27 to 33, both inclusive, of the report correctly <br />sets forth that part of the report of tbe poliey and review committee, <br />designated "Artiele II. Operating Principles," as revised and ap- <br />proved by the Colorado Water Conservation Board, but. it omits other <br />Dlaterial portions "f the Committee's report as revised and approved <br />by the Board, namely: <br />.. * * .. .. .. .. <br />The act.ion of the policy a[1d review committee will be presented to the Colora.do <br />Water Conservation Board for slIch action as the board deems proper. <br />The action of t.he Colora.do Water Conservation Board will he incorporat.ed in <br />the official comment8 of the State of Colorado, made ImrslUwt to sect,ioIl I of the <br />1044 Flood Cont.rol Act.. . <br />The authorization of the project will recognize the oper&ting principle", approved <br />bv the Colorado 'Va.ter Conservation Board. <br />. Prior to commencement of project construction, the following conditions prece- <br />dent mllst be satisfied: <br />(a) There ",rill be executed a payment CQlttract between the Eastem Colorado <br />C0118CrV8.ncy DiRtrict and the Unit.ed St.ates ill which will be incorporated the <br />8.ppro\'ed operating principles. <br />(b) There will be executed sHch contract with th8 Twin Lakes Reservoir & <br />Canal Co. as is necessary to make effective the approved operat.ing prinCiples. <br />(c) The East.ern Colorado CO[}$erVB.nc\F District will firml.... bi/Jd itMelf t.o the <br />operation oC th(~ project in accordance w(th t,he approved operating principles. <br />* * * '" III '" '" <br />It is recommCl.\de~ that this project shall hereaCter he referred to as the Fry- <br />ingpan-Arkal1saB1)roJect. Approval of this provision by eastern Colorado repre- <br />sentatives MhaU not. be implied as an abandonment of their expressed intention to <br />obtain approval of a project from the Gunniflon River nor shall approval ot this <br />provision by western Colorado representatives be const.rued as any Consent on <br />their part to the authorization of a..r.ruject fur the exportation of water Crom the <br />Gunnison River to eastern Colorad~ <br />The committee recognizes that. t.hf'r'approval of this report is not to serve as a <br />precedent or example for the appro{.a)- of any other transrnountain diversion oC <br />major proportions not heretofore authorized. <br />The policy of the State of Coloracto as initiat.ed in St.ate-wide meetings held <br />nnder the allspice~ of the State planning commiRsion at Denver and Grand Junc- <br />tion, and a8 .evidenced by resolutions dated June 15, 1935, and :February 28. <br />1936 was not a.dhered to because survevs of the cha.racter mentioned in said <br />resol~ltion8 V'ere not a.vailable to the comnlittee.
