The obligation to supply the minimum strea.m <br />flow as set forth in the above ta.ble on the Roaring Fork Hiver shall, to the extent. <br />of 3.000 acre-feet Bllnuall:'o', be 1\ project obligation to be supplied from any waters <br />di\"erted from t.he south tributaries of Hunter Creek, Lime Creek, Last Chance <br />Creek, or any of them. <br />The Twin Lakes Reservoir & Callal Co. shall not. be required to refrain from <br />diverting water under its exist.ing decrees from the Roaring Fork River except to <br />the extent that a like Quantit.y of replacement water is furnished to said compauy <br />without. charge therefor thrnllgh and by means of project diversions. <br />If by rea.son of storage capacit.y in the Aspen Re..~ervoir. the Twin Lakes Reser- <br />voir & Canal Co. derives addit.ional waLer or other beneflts or advallt81l;eS it would <br />noL have realized had this project not been constructed, then nothing -herein con~ <br />tained shall prevent the project from making appropriate charges for such water <br />or other benefits or advantages. <br />11. All lands acquired for project construction and operation and water sur- <br />faces of project f('scn'oirs will be open to the public for recreational purposes, <br />excepting those areas reserved by t.he operating agency. <br />12. The project. will be operated in such R manner t.hat those in eastern Colorado <br />using project water imported from the Colorado Ri....er Basin for domestic pUr~ <br />poses shall have preference over tho~e claiming or using water for any other pur~ <br />pose. . <br />13. The project is to be operat.ed in sllch a manner as to secure the greatest <br />benefit from the uee a.nd reuse of imported project .....aters within project bound6.rie~ <br />in the Stat.e of Colorado. <br />14. Any and all benefit.s a.nd rights of western Colorado water users in and to <br />water stored in Green Mountain Resen'oir, as described and defined in Senate <br />Document 80, Seventy-fifth Congress, first session, shall not be impaired or <br />diminished by this project. <br />.. 15. The project, its operation, maintenance, Bnd use shall be subject to the <br />provisions of the upper Colorado Ri....er Basin compact of October 11, 1948 <br />(Public Law 37, Blst Cong.. 1 sess.), the Colorado Ri....er compact of No\'ember 24, <br />1922 (H. Doc. 605, 67th Cong., 4th 5ess.), and the Boulder Canyon Project Act <br />of December 21, 1928 (45 Stat.. 1057-1064). In the event any curtailment of use <br />of Colorado River water in the State of Colorado is necessary to satisfy the pro- <br />visions of the Colorado River compact or the upper Colorado River Basin earn. <br />pact, then the diversions by the project for use in eastern Colorado shall be <br />curt.ailed before there is any curtailment of the right to store water in Aspen <br />Re~ervoir in & quant.ity not in e:tce!'ls of the capacity of that reRervoir (or uee in <br />west.ern Colorado in accordance with these operating principlca:. <br />16. The Secret.ary of the Interior shall at any time have the option to obtain or <br />require the tran!'lfer to the United States of any and 811 rights initiated or.a:equired <br />by the appropriation or use of water through the works of the project in eastern <br />Colorado, e:rcept vested rights to present appropriations; provided, however, thai <br />the _ title so 'aken shall be subject to a beneficial use o( such water as may be <br />
