As used herein- <br />(a) "Projed" means that certain enterprise planned and designed by the <br />]3.ur€'au of Reclamat,ion, Department of the Interior, fur the trnnsmountain <br />diversion of water from the headwaters of the Fryingpan River and other tribu-' <br />taries of the Roaring Fork River to the basin of the Arkansas River, together <br />with all of its appurtenant works and facilities in both eastern a.nd west~rn <br />'Colorado. <br />(b) "Eastern Colora.do" means that portion of the State of Colorado lying <br />within the natural drainage basin of the Arkansas River, <br />(c) "Western Colorado" means that portion of the State of Colorado lying <br />within the natural rJrainage basin of t.he Colorado River and served by diversions <br />made from the Colorado River, or its tributaries, above its confluence with the <br />Gunnison River. <br />(d) "Eastern Colorado Conservancy District" means that entit,y to be hereafter <br />created to contract for payment to the United Statcs of an appropriate portion of <br />project costs allocated to certain water uses in eastern Colorarlo. <br />(e) "Aspeu Resen.oir" means not only the reservoir pre~ently planned for <br />COl18truation near the to''t'll of Aspen a.<; part, of t.he project. but, :l.]!-;o, unless Lhe <br />eonLext requires otherwise, any other reservoir that mny be const,rllctec1 in wp-st~rn <br />Colorado above the town of Aspen in lieu of that reservoir for the purpose of <br />protcctin'g water uses in western Colorado. <br />(f) "C. f. 5." means cubic feet of water per second of time. <br />2. The Aspen Reservoir shall he con8t.ruct.ed and maintained on the Roaring <br />Fork Rh..er above the tOWD of Aspen, Colo., with an ReLive capacity.of ahout <br />28,000 acre-feet and with a reasonable expectancy that it will fill annually, The <br />28,000 acre-feet of water ~tored therein shall be available for replacement purpo:o;p-s <br />in ,....estern Colorado. The co::;t of cOllst.ruction and perpetual operation and maintenance of the <br />Aspen Reservoir shall be a charge against the project and shall be paid from <br />project,revenues or a.s otherwi~e pro\'idcd by the COllgre~s of the United States. <br />4. The A5pcn Resenoir shall be completed before any water is diverted to <br />eAStern Colorado by means of the project. <br />5. The primary purpose of Aspen Reservoir is to furnis.h, in like manner as if <br />the project were cOllstrllct~d by a wa.ter conservancy district organized pursuont <br />to the laws of the State of ColoradQ, t.he water required for the protection of <br />western Colorado water u~ers by the provi):;ions of section 1, chapter 192, Colorado <br />Sessioll Ltlw.'i, 1943, readillg a,,,, [ollon'.,: "Prot'ided, however, That any works or <br />,facilit,j~ planned and designed for the exportation of water froTTI the natural <br />basin of, the Colol:fldo River a.nd its t.ribut.aries in Colorado, by any district cf6atea. <br />. under thie chapter. shall be subject to the provisions of the Colora.do River com- <br />pact and the Boulder Canyon Project Act, a~ amended; that any such works <br />or facilities shall be de,.,igned, constructed, and operated in such a IDfI,llnpr that <br />. the present 'a.ppropriations or. waler, and in addition thereto prospective uses <br />of water for irr!g:ation and other beneficial c01l8umptive-use purpo::;e~, including <br />commmpti\',e use~ for domestic, minillg, and indllst,rial purposes, wit,hin the Hat ura.l <br />(basin of the Colorado River in the State of Colorado, from wbicl> water is exported, <br />w.lll D<?t be impaiz:ect nor incrceserl in cost at, the expense of the wntf'r lI1-R.rs wit.hin <br />the stud natural basin; and that the fa.cilities and other mea.ns for the accompHsh- <br />~ment of 'said' purpose' shall be incorporated in, and'made a part 'of, t:l.llY project <br />pl&ns for the exportation of water from said natural basin ill Colorado." <br />
