September 28-29, 1989, Board Meeting-- <br />Animas~La Plata Project Cost-Sharing Agreement <br /> <br />Introduction <br /> <br />Pursuant to section 37-60-121(6.1), CRS, the Board has been <br />authorized to enter into a binding agreement with the Secretary <br />of the Interior to contribute, on a non-reimbursable basis, <br />$5.6 million for the construction of the Ridges Basin Dam of <br />the Animas-La Plata Project. This legislation was enacted in <br />response to the June 30. 1986. Binding Agreement for Animas-La <br />Plata Project Cost-Sharing which specifies that the $5.6 <br />million "shall be provided on a schedule acceptable to Colorado <br />and the Secretary beginning in the first year of construction <br />of said dam." <br /> <br />At its May, 1989, meeting. the Board authorized me to enter <br />into negotiations with the Bureau of Reclamation based upon the <br />two numbered principles found on page 3 of the enclosed <br />memorandum. However, proceeding as then contemplated has not <br />proved to be the most desirable course of action. Therefore, I <br />am bringing this matter back to the Board for further <br />guidance. <br /> <br />Discussion <br /> <br />One of the things which prompted my recommendation at the <br />May Board meeting was the prospect that the Division of <br />wildlife and The Nature Conservancy (TNC) would reach agreement <br />on the disposition of the reverter interest which TNC has in <br />the property owned by the Division which is needed for the <br />Ridges Basin Dam and Reservoir. However, this has not proved <br />to be the case. Thus, I anticipate that the Division will <br />shortly decline a formal offer from the Bureau of Reclamation <br />for the acquisition of its property. thus forcing Reclamation <br /> <br />0886E* <br />
