<br />releases may be required to avoid a material depletion of <br /> <br /> <br />the water of the Arkansas River as defined in Article 3 of <br /> <br /> <br />the Arkansas River Compact, C.R.S., 1953, 148-9-1. <br /> <br /> <br />(c) Except as provided by paragraph (b) above, any water tempo- <br /> <br /> <br />rarily detained in the reservoir as a result of the reservoir <br /> <br /> <br />inflow exceeding the design outlet capacity of the reservoir <br /> <br /> <br />shall be released as soon as possible. <br /> <br /> <br />(d) All releases from the reservoir as set forth in (a), (b) <br /> <br /> <br />and (c) above, shall be passed down the Purgatoire River <br /> <br /> <br />without interference by water users in i\;lIle District irrigab1e <br /> <br />area. <br /> <br /> <br />2. District Operation, Non-irrigation Season <br /> <br /> <br />(a) During the non-irrigation season the District will provide <br /> <br /> <br />an allowance for stock watering purposes of not more than a <br /> <br /> <br />daily mean flow of five second-feet or its volume equivalent <br /> <br /> <br />measured at a gage to be located near and above the Baca River <br /> <br /> <br />headgate. If the stream gains from Trinidad ram to the said <br /> <br /> <br />gage are insufficient to fulfill the allowance, an equivalent <br /> <br /> <br />volume of reservoir inflow will be released to satisfy <br /> <br /> <br />stock water demands within the allowance. <br /> <br /> <br />(b) During the non-irrigation season the District will exercise <br /> <br /> <br />the direct flow water rights and the District storage right <br /> <br /> <br />only at such times and to the degree as necessary to assure: <br /> <br /> <br />(1) That the maximum possible storage of reservoir inflow <br /> <br /> <br />is accrued. <br /> <br />Page 14 <br /> <br />
