Two <br />years ago, Mr. Chairman, I appeared before you with regard to a <br />proposed wild and Scenic River designation for the Cache la <br />poudre River in northern Colorado. At that time it became <br />apparent that further work on a compromise was necessary before <br />the poudre could be designated as a wild and Scenic River. You <br />will recall that water user groups were holding out for a number <br />of reservoir sites between designated segments of the proposed <br />wild and scenic river corridor, while certain environmental <br />groups; the Sierra Club included, wanted the entire river <br />designated above the canyon's mouth northwest of Fort Collins, so <br />as to exclude future water storage opportunities. <br /> <br />Earlier this year, the House of Representatives passed a <br />poudre wild and Scenic River bill which was jointly supported by <br />the Sierra Club and the Northern Colorado Water Conservancy <br />District. As a result, when the Senate also acts, 75 miles of <br />the poudre will be a wild and Scenic River, while the water users <br />of Northern Colorado pursue the poudre water and power project in <br />that portion of the stream which was left undesignated below the <br />long uninterrupted reach designated upstream. <br /> <br />The poudre experience demonstrates that the issue of <br />federal ~eserved water rights can be dealt with explicitly. <br />There the existence of a reserved right was recognized and dealt <br />with directly, in those circumstances expressly establishing the <br />
