-e

-3-

~.1

Such determination as regards uses of water above Gaddoa Reservoir, how-

d.
ever, involves many complications. In this latter connection, consideration

~
.:.
~
-..I

was given to certain methods of approach which were later used by Mr. Knapp.
tL
His method of approach requires certain assumptions as to losses of water

in transit and of river accretions from point to point along the river which,

due to weather and other conditions, vary from week to week; also time inter-

vals covered in the transit of water between headgates and gauging stations,

trial and error computations of an involved character and other factors not

readily susceptible of accurate determination.

Unfortunately, the daily flow of a river will not await such determinations.

.~I

Its waters must be administered as they flow, ~and until a "backlog" of storage
)
haS been accumulated in Gaddoa Reservoir in sufficient amount to permit adjust-

ments between the Golorado ditches and between the two States, it was felt

that long and involved computations were not justified, at least pending a

determinntion by the Court of the questions at issue.
'"1 co.:
As we understand i t,\ the principal purpose of the Stipulation was to pro-
'-

tect past or historic uses of water out of the river, both in Colorado and

in Kansas, of which there is a record covering a period of many years. It

was also thought that, due to the relatively small quantity of water in Gaddoa

Reservoir in 1943 available for adjusting daily errors of administration, and

to unpredicable stream flow into and below Caddoa Reservoir before the close

of the irrigation period and also pending a clarification of the diversity
"-
of interpretations which ha~ been placed upon the Stipulation, no intricate

plan of administration should be adopted for 1943.

~.-- --- ~ - . -In .thisconnection, it may- be ~ stated that-the administration -of--the-ri ver

was pleced upon a priority basis on May 29th, on which date there were about
