The operating principles do not provide for a change of use of the District water supply <br /> <br />to municipal and industrial purposes; consequently, the application has been held in abeyance by ~l"-(j <br /> <br />the Water Court until such time as ~ operatmg pnnclples have been amended to alli5W1nf ~:~ <br /> <br />change of use, r ~- q'. <br />, <br />l <br /> <br />The District has requested that Project operations be reviewed for potential <br /> <br />implementation of basic conditions (d) and (e) for maximum utilization of the storage capacity of <br /> <br />Trinidad Reservoir as included in House Document No. 325, 84th Congress, 2nd Session, <br /> <br />Condition (d): <br /> <br />f..10-f <br />(/h\.~ <br />'f&~ <br /> <br />"By regulation of Trinidad Reservoir of summer flows historically diverted <br /> <br />to project lands provided that future streamflow records disclose such <br /> <br />further regulations would not materially increase depletions or that any <br /> <br />material increase in depletions be compensated by suitable replacement to <br /> <br />lands served by John Martin Reservoir." <br /> <br />Regulation of summer flows historically diverted to project lands is that increment offlow <br /> <br />that was diverted to project lands by the direct flow rights because the water was available at the <br /> <br />time and without an irrigation requirement Since there was not an irrigation requirement, the <br /> <br />water diverted less evaporation losses resulting from the diversion and distribution of the water <br /> <br />onto the fields returned to the Purgatoire River and was available to downstream water users. <br /> <br />26 <br />
