}'163

~\
~

.

on March 15, 1989, termination of the Hoehne Ditch Company's right to divert water during the

non-irrigation season for stock watering and incidental domestic uses and this water be returned r-~

to the District water supply. The Hoehne Ditch Company had historically diverted 200 to 300 b., !t-ocJv....

acre feet during the nonirrigating season for stockwater purposes. Therefore, the volumetric limit

for stock water releases should be reduced to 1200 to 1300 acre feet, including the river gains

from Trinidad Dam to the Trinidad gauge during the non-irrigation season.

~

The operating principles should be modified to ~RLoject operations for stock water

releases during the non-irrigation season and to reduce the total stock water allowance in

accordance with the Court-ordered termination of the Hoehne Ditch Company's stock water
<

diversion rights during the non-irrigation season. The o~erating principles should only be cha~ged

so that the general interpretation is the same as Reclamation's interpretation above and the

. equivalent volume of 5.0 cfs as measured at the Trinidad gauge inclusive of river gains from

Trinidad Dam should be educed to 4.0 cfs t account for the termination of the Hoehne Ditch

Company's right to divert stock water during the non-irrigation season.

r 3. Irrigable Lands ~
?--
The operating principles limit the Project irrigl!ted acreage to 19717 acres of class I, .2
" -.-c:::::-

and 3 lands. As reported in the 1988 review of operating principles report, the total irrigated
- -

acreage of 19717 acres had not been exceeded but the district was technically in violation of the

operating principles because lands other than class 1, 2, and 3 were being irrigated. The

Reclamation Reform Act of 1982 exempted Corps projects from Reclamation Law. Since land
""

requirements of the Trinidad Project. The 1986 amendment of the contract between Reclamation

~
~.
c.e

classification is a requirement of Reclamation Law, the 1882 Act eliminated land classification

.

18
