<br />Dear Gentlemen:
<br />
<br />As you are aware, the' City of Lamar, Colorado occasionally
<br />purchases Fryingpan-Arkansas F.iver Project water to utilize to
<br />re-charge the City of Lamar's well field, located generally south
<br />of Lamar, ,Colorado. As you are probably also aware, the City
<br />transports this water to its re-charge diversion point through the
<br />Fort Bent Ditch Compa.ny's structure. The problem is, of course,
<br />that the City is not able to transport the water through the Fort
<br />Bent structure as quickly as it has been able to take delivery on
<br />the water down the river. We are certainly mindful that you have
<br />allowed us to temporarily hold up the water in John Martin
<br />Reservoir, in years ,past, to enable us to take delivery througl1
<br />the Fort Eent and thereby use the water. This has been an ideal
<br />situation for us, as the City of Lamar owns approximately 20-25%
<br />of the Fort Bent, and all parties can work together to effectuate
<br />delivery of our water.

<br />Mr. Witte has explained to us the problems that this has
<br />caused, both for himself ano the individual Compact represen-
<br />tatives, as each representati.ve must be contacted to obtain
<br />permission of the Compact, to a}low us to temporarily detain the
<br />water, for short. periods only, i.n John ~la.rtin. Therefore, t.he
<br />City is willing to give a 90-day notice to the Compact., prior t.o
<br />using John Martin as a regulatory device to insure efficient use
<br />of our wat.er. We would propose that Ollr :notice be sent both to
<br />Mr. Witte and to the Compact office, and hope that such a notice
<br />period will be sufficient to address the problems that have
<br />confronted you in years past. Please be assured that the City has
<br />no intention of seeking any sort' of lon9-term storage of this
<br />water in John ~lartin, as the water is only useful to us curing
<br />such periods that long-term storage would be contrary to our
<br />purposes.
