Reclamation prepared draft amended Operating Principles adopting the <br />recommendations of the final report and circulated the draft Operating Principles to interested <br />parties for review and comment by letter dated December 24, 1996. Reclamation received <br />comments from the Army Corps of Engineers, Colorado; Kansas, Purgatoire River Water <br />Conservancy District; the City of Trinidad; and the Model Land and Irrigation Company. <br />Reclamation subsequently had meetings with Kansas, Purgatoire River Water Conservancy <br />District and the Model Land and Irrigation Company to discuss their respective comments. <br /> <br />. <br /> <br />After considering all comments and subsequent to the meetings referenced above, Reclamation <br />prepared the enclosed proposed final Operating Principles for the Trinidad Dam and Reservoir <br />Project. The proposed final Operating Principles have minor editorial and clarification language <br />changes and one major change which is deletion of objectives (d) and (e) of House Document <br />No. 325, 84th Congress, 2nd Session from the draft amended Operating Principles enclosed in <br />our letter of December 24, 1996. Kansas commented that to allow implementation of conditions <br />(d) and (e) is premature and that more specific proposals must be developed to demonstrate no <br />injury to downstream Kansas and Colorado water users. Reclamation believes that conditions <br />(d) and (e) themselves require development of specific plans prior to implementation, however, <br />Kansas did not believe it would have an opportunity to evaluate those plans when they were <br />developed. Therefore, Reclamation has deleted conditions (d) and (e) from these amended <br />Operating Principles; however, specific plans for implementation of conditions (d) and (e) <br />may be developed at any time, in accordance with Article VI of the Operating Principles, the <br />Operating Principles may be reviewed and amended not more than once a year at the request of <br />any of the signatory parties. <br />
