<br />OcH8-Z00Z 10:05am From-USBR WCAO Orand Junction CO <br /> <br />97D-Z48-0601 <br /> <br />T-IZ7 P.014/017 F-345 <br /> <br />Contract No. <br /> <br />UNITED STATES <br />DEPARTMENT OF THE INTERIOR <br />BUREAU OF RECLAMA TlON <br /> <br />RECOVERY IMPLEMENTATION PROGRAM <br />UPPER COLORADO RIVER BASIN <br />GRAND V ALLEY PROJECT <br />mGHLINE LAKE WATER STORAGE SPACE <br /> <br />CONTRACT AND GRANT OF PERPETUAL EASEMENT <br /> <br />THIS CONTRACT Al\'D GRANT OF PERPETUAL EASEMENT (Contract), made this <br />day of ,2002, in pursuance of !he Act of June 17, 1902 (32 Stat. 388), <br />and the Endangered Species Act of 1973 (87 Stat. 88 [16 USC Sec. 1531-15441), and acts <br />amendatory thereof or supplementary thereto, between THE UNITED STATES OF AMERICA, <br />hereinafter styled the United States, acting through such officer as is authorized therefore by the <br />Secretary of the Interior, and <br /> <br />STATE OF COLORADO FOR THE USE AND BENEFIT OF COLORADO GAME, <br />FISH AND PARKS COMMISSION; hereinafter styled Grantor <br /> <br />WITNESSETH, That for and in consideration of the mutual agreements herein contained, <br />the parties hereto do covenant and agree as follows: <br /> <br />1. The Grantor does hereby grant, with covenants of warranty, and by this Contract <br />convey to the United States free of lien or encumbrance, except as otherwise provided herein, !he <br />following-described interests in real property situated in the County of Mesa, State of Colorado, <br />to-wit: <br /> <br />A perpetual easement to use and reuse approximately 320 acre-feet of water storage space in <br />Highline Lake, to temporarily store Grand Valley Project inigation water in and pump back out <br />of Highline Lake during the months of August, September and October each year. Said storage <br />space being the top tWO vertical feet of Highline Lake located between elevations 4698.6 and <br />4700.6 feet above mean sea level. Highline Lake is located in the W1I2 of the Fractional NE1I4 <br />of the NE1I4, the Fractional NW1I4 of the NE1I4, the EI/2 of the Fractional NEl/4 of the <br />NWl/4, the SE1I4 of the NWl/4 and the r-.TE1I4 of the SWl/41ying Easterly of the ditches <br />named 49 Main and 49B, the SWl/4 of the NEl/4, the Wl/2 of the SEl/4 of the NE1I4, the <br />NW1I4 of the SE1I4, the Nl/2 of the SWII4 of the SEl/4 and the N1I2 of the SEl/4 of the <br />SW1I4 of Section 5 Township 2 North, Range 3 West, Ute Meridian, Mesa County, Colorado <br />and has a water surface area of approximately 160 acres. The above elevations are based upon <br />the Highline Lake spillway crest elevation of 4700.7 feet above mean sea level. <br /> <br />(a).
