Colorado River <br />Basin Salinity Control Project. Mesa County, Colorado. <br /> <br />The Department of the Army, Corps of Engineers, exercises <br />regulatory jurisdiction on rivers. streams, lakes, impoundments, <br />and wetlands. Section 404 of the Clean Water Act requires that <br />any individual or entity proposing to discharge dredged or fill <br />material into these "waters of the United States" obtain a <br />Department of the Army permit prior to such a discharge. <br /> <br />However, certain activities which involve the placement of <br />dredged or fill material in a "water of the United States" do not <br />require a Department of the Army permit under Section 404 of the <br />Clean Water Act. These exempted activities include discharges <br />associated with the construction or maintenance of irrigation <br />ditches, siphons, pumps, headgates, wingwalls. weirs, diversion <br />structures and other facilities which are appurtenant and <br />functionally related to irrigation ditches. In general, <br />improvements to the Price and Stubb Ditch such as lining, piping, <br />and relocating would not require a Department of the Army permit. <br />However, activities included in this project which may involve a <br />discharge into "waters of the United States" such as construction <br />of detention dikes and ponds. relocation of roads, disposal of <br />waste material, and mitigation work may require Department of the <br />Army authorization. <br /> <br />Before we can determine if a Department of the Army permit <br />is required for this project, we will need more information on <br />the extent of and impacts to wetlands and other "waters of the <br />United States" resulting from this project. <br />45 <br />
