,-IIQ

GIJ'''~

DRAfT

should not allow Western to apply the 1983 Agreement to State and private

projects in derogation of both equitable and legal contract principles and the

express terms of the 1983 Agreement itself. Finally, the Commission urges

FERC to require Western to follow the express terms of the 1983 Agreement and

reflect both the financial obligations and the depletion impacts of the

Animas-La Plata and Navajo Indian Irrigation Projects in its power rates.

The Commission must protest Western's interim rates reflected in Rate

Schedule SLIP-FS because they are not adequate to ensure the full repayment

required by the CRSP Act. The Commission respectfully requests that FERC

remand the rates to Western and require that Western revise the rates in

accordance with the law.

10
