<br />17. The Colorado River Water Conservation District of the State
<br />of Colorado shaH acqllire tit.le to storage of water in Ruedi Reservoir
<br />and any reservoir constructed in addition theret.o, by appropriake
<br />proceedings in t.he COUlts of the State of Colorado. The Southeastel'll
<br />Color'l.do Water Conservancv District of thc St.ate of Colorado shall
<br />likewise acquire title to tJJC ,,:ater reqllired by t.he project for diversion
<br />to t.he Arkansas Valley. The Secretary of the Interior shall at any
<br />time after the authorization of the project have the OptiOll to obtain
<br />or reqllire the t.ransfer to the United States of UJ1Y and all rights
<br />initialed or acquired by appropriation as herein set forth, Provided,
<br />howerer, That the rights so taken shaH be subject t.o a benoficial use
<br />of such water as may be provided in the repayment contract or con-
<br />tracts, and subject to all the operating principles herein set forth.
<br />18. No translllounta.in diversion of water shall ever be nUlde through
<br />the collection lmd di,'ersion system of t.he Fryingpan-Arkansas project
<br />in exce.ss of the quantitative. limitations :lnd ('.(Jnditions established
<br />by this document.: Provided, however, That when, lIndeI' the laws of
<br />the State of Colorado, there may be additional water available for
<br />such collection and diversion which is not at the time of diversion
<br />reqllired for beneficial Use in western Colorado or for lil\in;:; interstate
<br />water cOlnpa.ct u{.,'1:eell1ents, then such wate.r In:!.)' be cullected and
<br />diverte<1 for beneficilll use in the Arkansas "':,lley: Provided, fu,rther,
<br />That such additional diversion shall only be made with the mutual
<br />consent of each of the following agencies of the State of Colorado,
<br />to wit: the Colorado Water Conservation Board, the Southwestern
<br />'Vater Conservation Dist.rict, t.he Colorado R.iver Water COl1servn.-
<br />tion District, and the Southeastern Colorado Water Conservancy
<br />District,.
<br />19. To assure project. opeI'ltt.ion in confornIity wit.h the operating
<br />principle heretofore st,ated, to provide a means for the collection and
<br />interchange of information !Lnd to provide a method for the con-
<br />tinued study of project operations to the end that, if the stated
<br />operating principles may be improved upon, recommendations for
<br />changes may be made to the c-ontracting parties, a conunission Hhu.ll
<br />be created in an appropriate maIUler to he composed of one repre-
<br />sent.ative of the. Sout.heastern Colorado IVater Conserva.ncy District,
<br />one representatIve of the Colorado River IVater Conservation Dis-
<br />trict, two representati,oes of the United States, Rnd one representa.tive
<br />of the State of Colol"Hlo appointed by the Colorado IVatel' Conser-
<br />vation Board after consultation with the Colorado Game and Fish
<br />Commission. The powers of such commission shall he limited to the
<br />eollect.ion of data, the making of findings of fact" and the suggestion
<br />of changes In ~pe-rating principles.
<br />The:-ie opera.tmg priIlc-iples shall be deemed to hale amended and
<br />take the place of tJlOse operating principles signe_d and executed on
<br />April 30, 1950. These opcrat.ing principles shall be a,nd do consti-
